नैनीताल। उत्तराखंड हाईकोर्ट ने प्रदेश में लागू समान नागरिक संहिता (यूसीसी) के एक प्रावधान पर सवाल उठाने वाले याचिकाकर्ता को आड़े हाथों लिया है। हाईकोर्ट ने सुनवाई के दौरान टिप्पणी करते हुए कहा कि बिना शादी किए निर्लज्जता के साथ रह रहे हैं तो फिर निजता का हनन कैसे। कहा कि राज्य सरकार ने भी यह नहीं कहा है कि आप साथ नहीं रहते हैं।
दरअसल, याचिकाकर्ता ने यूसीसी के इस प्रावधान को अपनी निजता का हनन बताते हुए चुनौती दी थी। याचिकाकर्ता का कहना था कि यह प्रावधान उनकी गोपनीयता पर हमला है। उन्होंने यह भी तर्क दिया कि अंतरधार्मिक जोड़े होने के नाते समाज में रहना और रिश्ते का रजिस्ट्रेशन कराना उनके लिए मुश्किल है।
याचिकाकर्ताओं के वकील ने दलील दी कि कई लिव-इन रिलेशनशिप शादी के बाद सफल होते हैं और यह प्रावधान उनके भविष्य और प्राइवेसी में बाधा बन रहा है। हाईकोर्ट के मुख्य न्यायाधीश जी. नरेंद्र और न्यायमूर्ति आलोक मेहरा की खंडपीठ ने कहा, “आप समाज में रह रहे हैं, जंगल में नहीं। पड़ोसियों से लेकर समाज तक सभी को आपके रिश्ते के बारे में पता है और आप बिना शादी किए, बेशर्मी से एक साथ रह रहे हैं, ऐसे में लिव-इन संबंध का पंजीकरण आपकी निजता पर हमला कैसे हो सकता है। ”
इससे पहले, यूसीसी के खिलाफ दायर जनहित याचिकाओं पर अदालत ने निर्देश दिया था कि यूसीसी से पीड़ित व्यक्ति उच्च न्यायालय का दरवाजा खटखटा सकते हैं। अदालत इस मामले पर 1 अप्रैल को आगे की सुनवाई करेगी।
